Acceptance of Terms
By creating an account, clicking "I agree," starting a free trial, or otherwise accessing or using the Service, you affirm that: (a) you are at least 18 years of age; (b) you have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent; and (c) you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you are entering into these Terms on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" and "your" refer to that entity.
We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. See Section 15 for details on how we notify you of changes.
Description of Service
Aria is an AI-powered voice receptionist platform that handles inbound phone calls on behalf of your business. The Service includes:
- AI call handling: Answering inbound calls using a natural language AI voice agent trained and configured for your business.
- Call routing and escalation: Classifying calls by intent and urgency, forwarding calls or sending notifications to you or your team as configured.
- Appointment booking: Scheduling, confirming, and managing appointments in connected calendar systems.
- Lead capture: Collecting caller information, recording intent, and logging leads in your Aria dashboard.
- Voicemail and message handling: Taking messages and delivering them by SMS or email according to your configuration.
- SMS follow-up: Sending automated SMS messages to callers following a call, as configured by you.
- Dashboard and reporting: A web-based dashboard where you can review call transcripts, recordings, booked appointments, and analytics.
- Outbound calling (Scale plan): AI-initiated outbound calls for follow-up sequences, as configured by you.
The Service is provided over the internet on a software-as-a-service basis. You access the Service through a web browser and configure it through the Aria dashboard. Aria uses Retell AI for voice processing, Twilio for telephony, Supabase for data storage, and Stripe for billing. These providers are subject to their own terms of service, which you agree to be bound by to the extent they apply to your use of those underlying services through Aria.
Account Registration & Security
To use the Service, you must register for an account by providing accurate and complete information including your name, business name, email address, and phone number. You agree to keep this information current and accurate throughout the term of your subscription.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to: (a) use a strong and unique password; (b) not share your account credentials with any person who is not authorized to access your account; (c) notify us immediately at support@bmbtstudio.com if you suspect unauthorized access to your account.
Each subscription is for a single business location unless you are subscribed to a plan that expressly supports multiple locations. You may not use a single account to provide Aria services to multiple businesses or clients without an explicit written agreement with BMBT Studio.
You must configure Aria with accurate information about your business, including the nature of your services, your service area, and any legally required disclosures. You are responsible for the accuracy of the information Aria provides to callers based on your configuration.
Subscription Plans & Billing
Aria is offered on the following subscription plans:

Plan pricing, inclusions, and features are subject to change. Current pricing is always displayed on the Aria website and in your account settings. We will provide at least 30 days notice before increasing pricing on your existing plan.
New accounts are eligible for a 14-day free trial, which includes 30 minutes of AI call handling. No credit card is required to start a trial. At the end of the trial period, you will be prompted to select a paid plan and provide payment information to continue using the Service. If you do not provide payment information, your account will be suspended and your data retained for 30 days before deletion.
Free trials are limited to one per business. We reserve the right to deny trial access or terminate a trial if we detect abuse, including creating multiple accounts to access additional free trials.
Subscriptions are billed monthly in advance, beginning on the date you activate your paid plan. Payments are processed by Stripe using the payment method you provide. All prices are in United States Dollars (USD) unless otherwise stated. You are responsible for any currency conversion fees charged by your financial institution.
By providing a payment method, you authorize BMBT Studio to charge that payment method for all amounts owing under these Terms, including monthly subscription fees and any applicable overage charges.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel auto-renewal from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period — you will retain access to the Service until that date and will not be charged for the next period.
You may cancel your subscription at any time from your account dashboard or by emailing support@bmbtstudio.com. Cancellation is effective at the end of your current paid billing period. We do not provide refunds for unused portions of a billing period, except where required by applicable law or at our sole discretion.
If your call volume exceeds the limits of your plan in a given billing period, we will notify you and you may be asked to upgrade your plan. On the Starter and Growth plans, calls beyond the plan limit may be subject to per-minute overage charges or service interruption as described in your account settings. The Scale plan includes unlimited calls.
You are responsible for all applicable taxes, including federal and provincial sales taxes (GST/HST, QST), VAT, and similar taxes applicable in your jurisdiction, except to the extent that we are required to collect and remit taxes on your behalf. Where applicable, taxes will be added to your invoice.
If a payment fails, we will attempt to retry the charge and notify you by email. If payment is not received within 7 days of the due date, your account may be suspended. Suspended accounts retain their data for 30 days. If payment is not received within 30 days of suspension, your account may be terminated and your data deleted in accordance with our data retention policy.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- For any illegal activity or in violation of any applicable federal, provincial, or local law or regulation.
- To deceive callers by misrepresenting the nature of the AI system, including representing Aria as a human being when a caller sincerely asks whether they are speaking with a human. Aria must be configured to disclose its AI nature when directly asked.
- To collect personal information from callers in violation of applicable privacy laws, including without obtaining required consents or disclosures.
- For telemarketing, cold calling, robocalling, or spam in violation of CASL, the CRTC's Unsolicited Telecommunications Rules, the U.S. Telephone Consumer Protection Act (TCPA), or any other applicable anti-spam or telemarketing law.
- To harass, threaten, or harm individuals.
- To circumvent any access controls, security features, or usage limits of the Service.
- To reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- To resell, sublicense, or offer the Service as a product to third-party businesses without a written reseller agreement with BMBT Studio.
- In any manner that could damage, disable, overburden, or impair the Service or interfere with other users' access.
- To violate any third-party rights, including intellectual property rights or privacy rights.
We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these acceptable use provisions.
Service Level
We target 99.9% uptime for the Aria Service, measured on a monthly basis, excluding scheduled maintenance windows. This uptime target is a goal, not a contractual guarantee. We do not offer a financially backed Service Level Agreement (SLA) unless otherwise agreed in a separate enterprise agreement signed by both parties.
We may perform scheduled maintenance on the Service from time to time, which may result in temporary unavailability. We will endeavor to schedule maintenance during off-peak hours and to provide advance notice via email or our status page at least 24 hours before planned outages.
The Service depends on third-party infrastructure providers including Retell AI, Twilio, Supabase, and others. Outages or degraded performance caused by these providers may affect the availability of the Service. We are not liable for service interruptions caused by third-party providers outside our direct control.
We are not liable for any failure to perform our obligations under these Terms where such failure results from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, cyberattacks, power failures, internet backbone outages, or government action.
The Service is not a substitute for emergency services. Aria is not connected to emergency dispatch systems. If your business receives calls that may involve a risk to life, you must configure your Aria agent to immediately refer callers to 911 or appropriate emergency services. BMBT Studio is not liable for harm resulting from reliance on Aria in a genuine emergency situation.
Healthcare & Legal Disclaimers
Aria is a communications and scheduling tool. It is not a licensed medical professional, legal professional, financial advisor, or emergency service. Aria does not provide medical advice, legal advice, financial advice, or any other form of professional advice regulated by licensing authorities.
If you use Aria in connection with a healthcare practice — including medical clinics, dental offices, mental health providers, physiotherapy, optometry, or any other regulated health profession — you acknowledge and agree that:
- Aria does not diagnose, treat, or provide medical advice of any kind. Aria's responses about health-related matters are limited to scheduling, general practice information, and directing callers to appropriate resources.
- You are responsible for configuring Aria appropriately for your healthcare context, including ensuring that Aria does not make clinical determinations.
- You must ensure Aria is configured to refer callers experiencing medical emergencies to 911 or your local emergency services immediately.
- You are responsible for compliance with all applicable healthcare regulations, including PHIPA (Ontario), HIPAA (U.S.), and any regulations of your professional regulatory body.
- You must execute a Business Associate Agreement with us before using Aria to handle Protected Health Information under HIPAA. Contact privacy@bmbtstudio.com.
If you use Aria in connection with a law firm, paralegal practice, or other legal services provider, you acknowledge and agree that:
- Aria does not provide legal advice, legal opinions, or legal representation of any kind.
- You are responsible for ensuring that Aria does not make statements that could constitute legal advice or create a solicitor-client relationship with callers.
- You must configure Aria's scripts to include appropriate disclaimers informing callers that communications with the AI receptionist do not constitute legal advice and do not establish a solicitor-client relationship.
- You are responsible for compliance with all applicable law society rules, rules of professional conduct, and regulations governing client communications in your jurisdiction.
For any other regulated professional service (accounting, financial advice, real estate, immigration, etc.), similar principles apply. Aria is a communications tool, not a licensed professional. You are responsible for ensuring your use of Aria complies with the rules of your professional regulatory body and does not expose your practice to liability.
Intellectual Property
The Aria Service, including its software, AI models, algorithms, interfaces, designs, documentation, and all content created by BMBT Studio, is owned by BMBT Studio and protected by Canadian and international copyright, trademark, patent, and other intellectual property laws. These Terms do not grant you any rights in BMBT Studio's intellectual property except the limited right to use the Service as described herein.
Subject to your compliance with these Terms and payment of applicable fees, BMBT Studio grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during the term of your subscription. This license does not include the right to reproduce, modify, distribute, or create derivative works of the Service.
You retain ownership of all content and data you provide to or generate through the Service, including your business configuration, call transcripts, customer information, and any data exported from the Service. You grant BMBT Studio a limited, non-exclusive license to use, store, and process your content and data solely to provide the Service to you and as described in our Privacy Policy.
If you provide us with feedback, suggestions, or ideas for improving the Service, you grant BMBT Studio a perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and commercialize that feedback without any obligation or compensation to you.
"Aria," "BMBT Studio," and associated logos are trademarks of BMBT Studio. You may not use our trademarks without our prior written consent. Nothing in these Terms grants you the right to use BMBT Studio's trade name, trademarks, service marks, logos, or domain names.
Data Ownership & Portability
Your customer data, call records, transcripts, and configuration data belong to you. BMBT Studio does not claim ownership of your business data. We process your data as a service provider, acting on your instructions, as described in our Privacy Policy.
You may export your data from the Aria dashboard at any time during your active subscription. Available exports include call transcripts (CSV/JSON), call recordings (audio files), appointment records, and lead records. We will make commercially reasonable efforts to maintain export functionality throughout the term of your subscription.
Following termination or cancellation of your account, your data remains accessible for 30 days, during which time you may export it. After 30 days, your data is permanently deleted from our systems as described in our Privacy Policy. We strongly recommend exporting your data before terminating your account.
We do not use your customers' personally identifiable information to train AI models without your explicit opt-in. We may use aggregate, anonymized, and de-identified usage data and call data to improve the Service. If you opt in to AI improvement programs (available in account settings), additional data may be used as described in the program terms.
Limitation of Liability
Please read this section carefully. It limits BMBT Studio's liability to you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BMBT STUDIO DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) Aria's AI responses will be accurate, complete, or appropriate for your purposes; (c) any defects in the Service will be corrected; or (d) the Service will meet your specific business requirements.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BMBT STUDIO, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS, LOSS OF GOODWILL, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BMBT STUDIO'S TOTAL CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO BMBT STUDIO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).
The limitations of liability in this section reflect a reasonable allocation of risk between the parties and are an essential element of the basis of the bargain between you and BMBT Studio. BMBT Studio would not provide the Service on these terms without these limitations. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you to the extent prohibited by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless BMBT Studio and its affiliates, directors, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
- Your use of the Service in violation of these Terms.
- Any content or configuration you provide to the Service, including inaccurate business information that leads to incorrect or harmful responses to callers.
- Your violation of any applicable law or regulation, including privacy laws, consumer protection laws, and professional regulations.
- Your violation of any third-party rights, including intellectual property rights or privacy rights of your callers.
- Your use of the Service to send commercial electronic messages in violation of CASL or other anti-spam legislation.
- Any claim by your customers or callers arising from their interaction with Aria as deployed by you.
Termination
You may terminate your account at any time by cancelling your subscription in your account settings or by contacting support@bmbtstudio.com. Termination is effective at the end of your current paid billing period. You will retain access to the Service until that date and will not receive a refund for the remaining portion of the current period.
We may suspend or terminate your account and access to the Service at any time, with or without cause, upon notice to you, except that we may terminate immediately and without notice if we determine that you have violated these Terms in a material way, including but not limited to violation of the Acceptable Use Policy (Section 5).
Upon termination of your account for any reason:
- Your right to access and use the Service ceases immediately (or at the end of your billing period in the case of voluntary cancellation).
- Your call forwarding configuration should be updated to direct calls to your original number or another destination — Aria will stop answering your calls.
- Your data is available for export for 30 days following termination, after which it is permanently deleted.
- All fees accrued up to the date of termination remain due and payable.
- Sections of these Terms that by their nature should survive termination will survive, including Sections 8 (Intellectual Property), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law).
If we materially breach these Terms and fail to cure that breach within 30 days of written notice from you specifying the breach, you may terminate your account and will receive a pro-rated refund of prepaid fees for the period after the effective termination date. This is your sole remedy for our material breach.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of competent jurisdiction in Toronto, Ontario, Canada, and you irrevocably consent to the personal jurisdiction and venue of such courts.
If you access the Service from outside Canada, you do so on your own initiative and are responsible for compliance with local laws to the extent applicable. Nothing in these Terms limits our right to seek injunctive or other equitable relief in any court of competent jurisdiction.
Dispute Resolution
Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute with BMBT Studio through good faith negotiation. Contact us at legal@bmbtstudio.com with a written description of the dispute and the resolution sought. We will endeavor to respond within 10 business days. The parties agree to negotiate in good faith for at least 30 days before escalating to any formal process.
If the parties cannot resolve a dispute through good faith negotiation within 30 days, either party may request mediation. If agreed, mediation shall be conducted by a mediator mutually agreed upon by the parties, or if no agreement is reached, appointed by a recognized mediation service in Toronto, Ontario. The cost of mediation shall be shared equally between the parties unless otherwise agreed. Mediation is non-binding unless the parties execute a written settlement agreement.
If mediation is declined or fails to resolve the dispute, either party may pursue its rights and remedies in a court of competent jurisdiction in Toronto, Ontario, as provided in Section 13. Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
To the fullest extent permitted by applicable law, you agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action against BMBT Studio.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page.
- Send an email notice to your registered account email address at least 14 days before the changes take effect for any material changes.
- For non-material changes (such as corrections, clarifications, or changes that do not adversely affect your rights), changes may take effect upon posting.
If you object to any change, you may terminate your account before the effective date of the change, in which case the pre-change terms will continue to apply to you until the end of your current billing period. Your continued use of the Service after the effective date of any change constitutes your acceptance of the modified Terms.
